Effective 3 October 2026
These Terms of Service ("Terms") govern access to and use of UserArchitect, including the public website, application, research tools and related services (the "Service"). By creating an account, starting a paid subscription or using the Service, you agree to these Terms on behalf of yourself and, where applicable, the organisation you represent.
You must provide accurate account information, keep credentials secure and ensure that only authorised people use your workspace. If you create or manage an account for an organisation, you confirm that you have authority to bind that organisation to these Terms. You are responsible for activity conducted through your account except to the extent caused by our breach of these Terms or applicable law.
Paid plans are billed through Stripe at the price and billing interval shown when you subscribe. Unless otherwise stated, subscriptions renew automatically until cancelled. You are responsible for applicable taxes, charges and authorised usage. Changes, cancellations and payment-method updates may be managed through the billing portal where available. Statutory refund or consumer rights are not excluded by these Terms.
You control the purpose, design and operation of the research you conduct using UserArchitect. You are responsible for participant recruitment, participant notices and consent, lawful collection and use of personal information, research ethics where applicable, accessibility of your study materials, and ensuring your questions, content and instructions are appropriate for the participants you invite.
You must not assume that UserArchitect makes a research activity lawful, ethical, accurate or suitable merely because the platform technically permits it.
You may install or use UserArchitect scripts, overlays or integrations only on websites, systems, prototypes and assets that you own or are authorised to test. You are responsible for the effect of any installed script on the target environment and for obtaining approval from the relevant website or system owner.
As between you and UserArchitect, you retain ownership of content and research data you submit to the Service. You grant us a limited licence to host, copy, process, transmit and display that material only as reasonably necessary to provide, secure, support and maintain the Service or comply with law.
You are responsible for the accuracy, legality, integrity and appropriateness of your content and for maintaining any independent records or exports you require.
You are responsible for determining whether your research involves personal, sensitive, confidential, health, financial, employment, government or otherwise regulated information and whether UserArchitect is appropriate for that use. Unless we have expressly agreed otherwise in writing, the Service is not offered as a specialist repository for regulated high-risk data.
You must comply with applicable privacy and data protection laws and must provide any notices and obtain any consents required for your collection and use of participant information. Our handling of information is also described in the Privacy Policy.
We apply security controls designed to protect the Service, but no system can be guaranteed to be free from vulnerabilities, interruption or unauthorised access. You must use reasonable security practices, protect credentials, remove access when team members no longer require it, and notify us promptly if you suspect account compromise.
The Service depends on hosting, networks, browsers and third-party services such as Stripe, Postmark and prototype providers. We aim to provide a reliable service but do not promise uninterrupted, error-free or permanently available operation. We may make reasonable changes to the Service for security, maintenance, legal, technical or product reasons.
You should not use UserArchitect as your only permanent repository for business-critical or legally required information. You are responsible for exporting and maintaining copies of research data that you cannot afford to lose. Although we may maintain operational backups, backups are not a customer archive service and we do not guarantee that deleted, corrupted or unavailable data can always be restored.
You must not use the Service to break the law, infringe another person's rights, conduct unauthorised surveillance or testing, distribute malicious code, interfere with the Service or another system, attempt to bypass security or usage controls, collect information without required authority or consent, or upload content that you do not have the right to use.
We may suspend access where reasonably necessary to address a security threat, unlawful use, material breach, non-payment or risk to the Service or other users. Where practical, we will give notice and an opportunity to remedy the issue. You may cancel your subscription using the available billing controls. Access to data may end after termination, so export important information beforehand.
UserArchitect and its software, interface, branding, documentation and underlying platform materials remain owned by us or our licensors. Except for the rights expressly granted in these Terms, no intellectual property rights are transferred to you.
To the maximum extent permitted by law, the Service is provided on an "as available" basis. We do not warrant that research results will be statistically valid, complete, accurate or suitable for a particular decision, or that the Service will meet every regulatory, security, archival or availability requirement. You remain responsible for professional judgement and decisions made using research outputs.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded or restricted, including rights that may apply under the Australian Consumer Law.
To the maximum extent permitted by law, neither party is liable to the other for indirect, special or consequential loss, or loss of profit, revenue, goodwill or anticipated savings, arising from use of the Service. Where we are permitted to limit our aggregate liability, our total liability arising out of or in connection with the Service will not exceed the fees paid or payable by you for the Service during the 12 months immediately before the event giving rise to the claim.
The limitations in this section do not apply to liability that cannot legally be limited and do not excuse either party from responsibility for its own fraud, wilful misconduct or other liability that applicable law requires it to bear.
You are responsible for claims arising from your unlawful research activity, your content, your infringement of third-party rights, or your installation or use of UserArchitect on systems you were not authorised to test. To the extent permitted by law, you will reimburse us for reasonable losses and costs arising from such a claim to the extent caused by your breach of these Terms or applicable law.
If part of these Terms is unenforceable, the remaining provisions continue to operate. A failure to enforce a right immediately does not waive that right. We may update these Terms where reasonably required for the Service, law or security. Material changes will apply prospectively and, where appropriate, we will require users to accept the updated Terms.
Questions about these Terms can be sent to hello@userarchitect.com.
